دخل نظام «نزع ملكية العقارات للمصلحة العامة ووضع اليد المؤقت على العقارات» حيّز النفاذ اليوم السبت 28 رجب 1447 هـ الموافق 17 يناير 2026، وذلك بعد مضي 120 يومًا من نشره في الجريدة الرسمية، ليمثل مرحلة جديدة في تنظيم وتوحيد إجراءات نزع ملكية العقارات ووضع اليد المؤقت عليها، وتطويرها بشكلٍ ميسَّر وشفاف، بما يضمن تحقيق التعويض العادل لمُلّاك العقارات والجهات صاحبة المشاريع، مع تعزيز الشفافية والحوكمة عبر توحيد مرجعية التنظيم والإشراف لدى الهيئة العامة لعقارات الدولة.

وتضمّن النظام حزمة من الإجراءات التي تكفل حقوق المُلَّاك والجهات صاحبة المشاريع، من أبرزها تقييم العقارات المنزوعة عبر مقيِّمين معتمدين من الهيئة السعودية للمقيّمين المعتمدين وفقًا لقيمة السوق العادلة، مع إضافة 20% إلى تلك القيمة عوضًا عن النزع، إضافة إلى منح تعويض عن وضع اليد المؤقت يعادل أجرة المثل مضافًا إليها 20%.

وبدأ تفعيل الإعفاءات المرتبطة بالنظام، التي تشمل إعفاء الملَّاك المنزوعة عقاراتهم من ضريبة التصرفات العقارية لمدة خمس سنوات بما يعادل القيمة الضريبية لمبلغ التعويض أو أقل منه عند شرائهم عقارات بديلة، تبدأ من تاريخ استلام مبلغ التعويض، إضافة إلى الإعفاء من رسوم الأراضي البيضاء في حال كان التعويض بأرضٍ بديلة.

ويشترط النظام الجديد قبل البدء في إجراءات النزع، البحث في عقارات الدولة عن بدائل تفي بأغراض المشروع المحقق للمصلحة العامة، وإن لم تتوفّر فيتم التأكّد من توفير الاعتمادات المالية اللّازمة قبل البدء في الإجراءات، وهو ما يسهم في رفع كفاءة الإنفاق ودعم التنمية المستدامة في مختلف مناطق المملكة.

The system for "Expropriation of Properties for Public Benefit and Temporary Possession of Properties" came into effect today, Saturday, 28 Rajab 1447 AH, corresponding to January 17, 2026, after 120 days from its publication in the official gazette. This marks a new phase in organizing and unifying the procedures for expropriating properties and temporarily possessing them, developing them in a simplified and transparent manner, ensuring fair compensation for property owners and project stakeholders, while enhancing transparency and governance through the unification of regulatory and supervisory references at the General Authority for State Properties.

The system includes a package of procedures that guarantee the rights of property owners and project stakeholders, the most notable of which is the evaluation of expropriated properties by appraisers accredited by the Saudi Authority for Accredited Valuers according to fair market value, with an additional 20% added to that value as compensation for the expropriation, in addition to providing compensation for temporary possession equivalent to the rental value plus 20%.

The exemptions related to the system have begun to be activated, which include exempting owners whose properties have been expropriated from real estate transaction tax for five years, equivalent to the tax value of the compensation amount or less when they purchase alternative properties, starting from the date of receiving the compensation amount, in addition to exemption from white land fees if the compensation is in the form of alternative land.

The new system stipulates that before starting expropriation procedures, alternatives that meet the project's public benefit objectives must be searched for within state properties. If none are available, it must be ensured that the necessary financial allocations are provided before starting the procedures, which contributes to enhancing spending efficiency and supporting sustainable development in various regions of the Kingdom.
