خلصت هيئة محلفين في ولاية نيو مكسيكو الأمريكية إلى أن شركة «ميتا» ضللت مستخدمي «فيسبوك» بشأن كيفية جمع معلوماتهم الشخصية وحمايتها ومشاركتها واستخدامها، في قضية مرتبطة بتداعيات فضيحة «كامبريدج أناليتيكا».
وجاء الحكم، أمس (الجمعة)، عقب محاكمة استمرت نحو أسبوعين في مدينة سانتا في، في دعوى رفعتها الولاية عام 2021 بعد الكشف عن حصول شركة الاستشارات السياسية «كامبريدج أناليتيكا» على بيانات شخصية لما يصل إلى 87 مليون مستخدم لـ«فيسبوك» عبر تطبيق تابع لطرف ثالث.
43.9 مليون مخالفة
وقالت وزارة العدل في نيو مكسيكو إن هيئة المحلفين خلصت إلى ارتكاب «فيسبوك» 43989725 مخالفة لقانون الممارسات غير العادلة في الولاية، بعدما اعتبرت تصريحات للشركة بشأن خصوصية المستخدمين وطريقة التعامل مع بياناتهم «كاذبة أو مضللة».
وشملت القضية تصريحات قالت الولاية إنها أعطت المستخدمين انطباعاً بأنهم يتحكمون في كيفية مشاركة معلوماتهم، إلى جانب تأكيدات بشأن تعامل المنصة مع المعلومات المضللة وخطاب الكراهية، وطريقة تطبيق معاييرها على المستخدمين.
كما تناولت القضية تعهدات الشركة بالتحقيق في التطبيقات الخارجية التي حصلت على كميات كبيرة من بيانات المستخدمين عقب فضيحة «كامبريدج أناليتيكا»، وحظر المطورين الذين يسيئون استخدام البيانات وإبلاغ الأشخاص الذين ربما تأثرت معلوماتهم.
عقوبات تحدد لاحقاً
ولم يحدد الحكم حتى الآن قيمة العقوبات المالية، إذ ستتولى المحكمة تحديدها في مرحلة لاحقة. ويسمح قانون نيو مكسيكو بفرض غرامة مدنية تصل إلى 5 آلاف دولار عن كل مخالفة متعمدة، ما يعني أن القضية قد تضع الشركة أمام عقوبات بمليارات الدولارات، إلا أن المبلغ الفعلي سيقرره القاضي.
من جانبها، قالت «ميتا» إنها تختلف مع قرار هيئة المحلفين، مؤكدة أنها ستواصل الدفاع عن موقفها في القضية.
A jury in the state of New Mexico, USA, concluded that the company "Meta" misled "Facebook" users about how their personal information is collected, protected, shared, and used, in a case related to the fallout from the "Cambridge Analytica" scandal.
The ruling came yesterday (Friday) following a trial that lasted about two weeks in Santa Fe, in a lawsuit filed by the state in 2021 after it was revealed that the political consulting firm "Cambridge Analytica" obtained personal data from up to 87 million "Facebook" users through a third-party app.
43.9 Million Violations
The New Mexico Department of Justice stated that the jury found "Facebook" committed 43,989,725 violations of the state's Unfair Practices Act, after considering the company's statements regarding user privacy and data handling to be "false or misleading."
The case included statements that the state said gave users the impression that they controlled how their information was shared, along with assurances about the platform's handling of misinformation and hate speech, and how it applies its standards to users.
The case also addressed the company's commitments to investigate external apps that obtained large amounts of user data following the "Cambridge Analytica" scandal, banning developers who misuse data, and notifying individuals whose information may have been affected.
Penalties to be Determined Later
The ruling has not yet specified the amount of financial penalties, as the court will determine them at a later stage. New Mexico law allows for a civil penalty of up to $5,000 for each intentional violation, meaning the case could expose the company to penalties in the billions of dollars, although the actual amount will be decided by the judge.
For its part, "Meta" stated that it disagrees with the jury's decision, affirming that it will continue to defend its position in the case.
