عبر حيلة ذكية تعمد تاجر عربي تشويه توقيعه البنكي ليعطل الصرف، وظن أن مرور سنوات السجن بالتقادم سيحميه من المساءلة القانونية، لكن قضاة دبي حسموا صراعاً مالياً امتد لأكثر من عقد.
وجهت محاكم دبي المدنية صفعة قانونية في ملف معاملات مالية معقد يعود لعام 2015، بعدما ألزمت مستثمراً من جنسية عربية بدفع 2.5 مليون درهم لأحد معارفه، إثر تعمده إفساد توقيعه الخاص على شيك لضمان رفض البنك له فور تقديمه للصرف.
بدأت الأزمة حين اقترض المدعى عليه المبلغ حشداً لسيولة عاجلة تتيح له تخليص شحنة تجارية لمؤسسته، متعهداً بإعادة المال بمجرد بيع البضاعة. ولإضفاء طابع رسمي، قدم شيكاً مالياً يعود لحساب شركته، لكن المفاجأة وقعت في أروقة البنك عندما ظهرت الإفادة الرسمية: «امتناع عن الصرف لتغير نمط التوقيع وعدم اكتماله».
حينها، لاحق المتضرر غريمه قضائياً ليصدر ضد الأخير حكم جنائي بالسجن ثلاث سنوات. ومع مرور السنين وسقوط العقوبة الجنائية بالتقادم، توهم التاجر أنه أفلت بالغنيمة، قبل أن يفاجأ بإجباره على العودة مجدداً إلى منصة القضاء المدني.
تجاهل التاجر البلاغات وامتنع عن الحضور أمام المحكمة، غير أن القضاة حسموا النزاع بحكم قضائي واضح: «الشيك التزام لا يسقطه التلاعب بالشكل، وحرمة الأموال لا تسقط بمرور الزمن دون إثبات السداد».
وقضت المحكمة بوجوب رد مبلغ 2.5 مليون درهم فوراً، مع تغريم المدعى عليه فائدة تأخير سنوية بنسبة 5% تُحسب بأثر رجعي ابتداءً من تاريخ المعاملة في 2015 وحتى إتمام الدفع، إلى جانب إلزامه بكافة المصاريف القانونية.
Through a clever trick, an Arab trader deliberately distorted his bank signature to obstruct the payment, believing that the passage of time would protect him from legal accountability. However, Dubai judges resolved a financial dispute that had lasted over a decade.
The Dubai civil courts dealt a legal blow in a complex financial case dating back to 2015, after obligating an investor of Arab nationality to pay 2.5 million dirhams to one of his acquaintances, following his deliberate act of ruining his own signature on a check to ensure the bank would reject it upon presentation for payment.
The crisis began when the defendant borrowed the amount to secure urgent liquidity that would allow him to clear a commercial shipment for his business, promising to repay the money as soon as he sold the goods. To formalize the transaction, he presented a financial check from his company’s account, but the surprise occurred in the bank's corridors when the official statement appeared: "Refusal to pay due to a change in the signature pattern and its incompleteness."
At that point, the aggrieved party pursued his rival legally, resulting in a criminal sentence of three years in prison against the latter. As the years passed and the criminal penalty lapsed due to the statute of limitations, the trader deluded himself into thinking he had escaped with the spoils, only to be surprised by being forced to return once again to the civil court.
The trader ignored the notifications and failed to appear before the court, but the judges resolved the dispute with a clear ruling: "The check is an obligation that cannot be nullified by manipulation of its form, and the sanctity of funds does not expire over time without proof of payment."
The court ruled that the amount of 2.5 million dirhams must be refunded immediately, imposing on the defendant an annual late payment interest of 5%, calculated retroactively from the date of the transaction in 2015 until payment is completed, in addition to obligating him to cover all legal expenses.
