يتصاعد الجدل حول ملفات الهجرة والاندماج والهوية في أوروبا، بعدما شهدت كل من إيطاليا وإسبانيا قرارات تستهدف حظر ارتداء البرقع والنقاب في الأماكن العامة والمدارس، مما فتح الباب أمام سجال سياسي وحقوقي ساخن.
كانت البداية من إيطاليا، حيث أقرت حكومة رئيسة الوزراء الإيطالية جورجا ميلوني مرسوماً جديداً يفرض حظراً شاملاً على ارتداء البرقع والنقاب داخل المدارس، إلى جانب وضع ضوابط جديدة لدمج الطلاب الأجانب.
ونص المرسوم على تحديد سقف بنسبة 30% لعدد التلاميذ غير المتمكنين من اللغة الإيطالية في كل صف دراسي، مع توفير أدوات إضافية لتعلم اللغة. وفي حال مواجهة أي تلميذ صعوبات جادة في الاندماج، ستتدخل الخدمات الاجتماعية، وسيكون الوالدان ملزمين بحضور دورات تعليمية مجانية للغة الإيطالية، تحت طائلة فرض غرامات مالية تصل إلى 1000 يورو عند عدم الالتزام.
وفي تعليقها على القرار، أكدت ميلوني عبر منصات التواصل الاجتماعي أن حظر البرقع يأتي ضمن «دواعي الأمن القومي»، مضيفة: «حين تُجبر امرأة، أو فتاة صغيرة، على تغطية وجهها، فإنها تُحرم من حقوق أساسية ومن الاندماج نفسه».
من جانبه، أوضح وزير التعليم الإيطالي جوزيبي فالديتارا أن عدم الكفاءة اللغوية يعيق التقدم التعليمي، مشيراً إلى وجود نحو 34 ألف صف دراسي تزيد فيها نسبة الأجانب على 30%، مؤكداً أن المرسوم يستهدف الوافدين الجدد بالأساس.
في المقابل، أثار القرار انتقادات حقوقية وسياسية واسعة، حيث حذرت منظمة «أنقذوا الأطفال» (Save the Children) من أن نقل الطلاب بناءً على جنسياتهم أو مستواهم اللغوي قد يؤدي إلى «خلق نظام تعليمي يفرز تلاميذ من درجة أولى وآخرين من درجة ثانية».
وعلى الجانب الآخر من شبه الجزيرة الإيبيرية، تصدرت مدينة «لاردة» التابعة لإقليم كتالونيا المشهد الإسباني بعد تصويت مجلسها البلدي بأغلبية 16 صوتاً مقابل 11 لصالح حظر «التواجد أو التنقل في الأماكن العامة بأشياء تغطي الوجه بالكامل».
وجاء القرار بفضل تحالف سياسي غير معتاد جمع الحزب الاشتراكي الكتالوني مع حزب «فوكس» اليميني وحزب «يونتس» الانفصالي. ورغم أن النص القانوني تجنب الإشارة الصريحة للبرقع أو النقاب لتفادي الطعون القانونية، إلا أنه يهدف مباشرة لمنع هذه الألبسة، مع فرض غرامات مالية على المخالفين واستثناء حالات ممارسة العبادة أو الاستخدامات المقبولة اجتماعياً.
ودافع رئيس «بلدية لاردة» فيليكس لاروسا عن القرار، بقوله: «العيش المشترك يعني احترام بعضنا البعض، واحترام بعضنا البعض يعني أيضاً اتباع القواعد».
وتعيد هذه الخطوة إلى الأذهان سابقة عام 2010 عندما كانت «لاردة» أول مدينة إسبانية تحظر النقاب، قبل أن تلغي المحكمة العليا الإسبانية القرار عام 2013 إثر طعن تقدمت به جمعية إسلامية، قاضيةً بأن الحظر ينتهك الحرية الدينية ويتجاوز صلاحيات السلطات المحلية.
وتأتي هذه التحركات الإسبانية والإيطالية لتسلط الضوء على التحولات السياسية في القارة الأوروبية، حيث يتصاعد التوتر بين القوانين المحلية ومبادئ الحريات الفردية والاندماج المجتمعي.
The debate over immigration, integration, and identity files in Europe is escalating, following decisions in both Italy and Spain aimed at banning the wearing of the burqa and niqab in public places and schools, which has opened the door to a heated political and legal discourse.
The beginning was in Italy, where the government of Prime Minister Giorgia Meloni approved a new decree imposing a comprehensive ban on wearing the burqa and niqab inside schools, alongside new regulations for integrating foreign students.
The decree stipulated a cap of 30% on the number of students who are not proficient in the Italian language in each classroom, with additional tools provided for language learning. In cases where any student faces serious difficulties in integration, social services will intervene, and parents will be required to attend free Italian language courses, under the threat of financial penalties of up to 1,000 euros for non-compliance.
In her comments on the decision, Meloni confirmed via social media platforms that the ban on the burqa falls under "national security concerns," adding: "When a woman or a young girl is forced to cover her face, she is deprived of basic rights and of integration itself."
For his part, Italian Minister of Education Giuseppe Valditara explained that language incompetence hinders educational progress, noting that there are about 34,000 classrooms where the percentage of foreigners exceeds 30%, emphasizing that the decree primarily targets new arrivals.
In contrast, the decision has sparked widespread human rights and political criticism, with the organization "Save the Children" warning that transferring students based on their nationality or language proficiency could lead to "creating an educational system that produces first-class students and second-class students."
On the other side of the Iberian Peninsula, the city of "Lleida" in the Catalonia region took center stage in Spain after its municipal council voted by a majority of 16 votes to 11 in favor of banning "presence or movement in public places with items that completely cover the face."
The decision came thanks to an unusual political alliance that brought together the Catalan Socialist Party with the right-wing "Vox" party and the separatist "Junts" party. Although the legal text avoided explicit reference to the burqa or niqab to avoid legal challenges, it directly aims to prevent these garments, imposing financial penalties on violators and exempting cases of worship or socially acceptable uses.
The mayor of Lleida, Félix Larrosa, defended the decision, stating: "Living together means respecting each other, and respecting each other also means following the rules."
This step recalls the precedent from 2010 when Lleida was the first Spanish city to ban the niqab, before the Spanish Supreme Court annulled the decision in 2013 following a challenge by an Islamic association, ruling that the ban violated religious freedom and exceeded the powers of local authorities.
These Spanish and Italian movements highlight the political transformations in the European continent, where tensions are rising between local laws and the principles of individual freedoms and societal integration.
