تفتح الهيئة العامة للأوقاف الباب واسعاً أمام إعادة إحياء الأصول الوقفية الضائعة أو المتوقفة عن العمل، من خلال إقرار لائحة تنظيمية متكاملة تمنح حوافز مالية ضخمة تصل إلى 10 ملايين ريال لمن يسهم في كشف وإبلاغ السلطات عن تلك الأوقاف المعطلة وفق ضوابط واضحة.

حددت اللائحة الجديدة مفاهيم دقيقة للأوقاف المستهدفة، وتشمل الأوقاف المجهولة التي غاب مكانها، أو ضاعت مستنداتها، أو فُقد ناظرها، أو تم إخفاء حقيقتها، إضافة إلى الأوقاف المعطلة التي توقف ريعها أو الاستفادة منها بالكامل لمدة سنتين متتاليتين.

ولقبول البلاغ واستحقاق المكافأة المالية التي تُقدر بما لا يزيد على 5% من قيمة عين الوقف وبحد أقصى 10 ملايين ريال، اشترطت التنظيمات الجديدة أن يستند البلاغ إلى مستندات معتبرة، وألا يكون المبلّغ هو ناظر الوقف أو المعتدي عليه، مع الالتزام بالإفصاح الكامل وتقديم بيانات دقيقة عبر القنوات الرسمية لمنصة الأوقاف.

ولا تتوقف اللائحة عند مجرد تلقي البلاغات، بل تمنح الهيئة صلاحيات واسعة لإثبات الوقفية، ورفع التعديات، وتعيين نظار جدد، وتفعيل مسارات استثمارية تنموية تشمل الدمج، أو التأجير، أو التمويل المتوافق مع الشريعة الإسلامية. كما تضمنت اللائحة مادة استثنائية تتيح إعفاء المبلّغ الذي سبق له الاعتداء على وقف مجهول من المحاسبة، شريطة مبادرته للإبلاغ وتسوية الوضع خلال عامين من تاريخ نفاذ اللائحة.

The General Authority for Endowments is opening the door wide for the revival of lost or inactive endowment assets, through the approval of a comprehensive regulatory framework that offers substantial financial incentives of up to 10 million riyals to those who contribute to uncovering and reporting these inactive endowments to the authorities according to clear regulations.

The new regulations have defined precise concepts for the targeted endowments, including unknown endowments whose locations are lost, or whose documents are missing, or whose overseers are absent, or whose true nature has been concealed, in addition to inactive endowments that have ceased to generate income or benefit for a continuous period of two consecutive years.

To accept the report and qualify for the financial reward, which is estimated at no more than 5% of the value of the endowment asset and a maximum of 10 million riyals, the new regulations require that the report be based on valid documents, and that the reporter is not the overseer of the endowment or the one who has encroached upon it, while adhering to full disclosure and providing accurate data through the official channels of the Endowments Platform.

The regulations do not stop at merely receiving reports, but grant the authority wide powers to establish the endowment status, address encroachments, appoint new overseers, and activate developmental investment pathways that include merging, leasing, or financing in accordance with Islamic law. The regulations also include an exceptional provision that allows for the exemption of a reporter who has previously encroached upon an unknown endowment from accountability, provided that they initiate the report and rectify the situation within two years from the date of the regulations coming into effect.
