وقّع حاكم كاليفورنيا جافين نيوسوم مشروع قانون يضيف عيدَي الفطر والأضحى إلى قائمة عطلات الولاية، في خطوة تمنحهما اعترافاً رسمياً في قانون كاليفورنيا وتتيح ترتيبات خاصة للموظفين والطلاب للاحتفال بهما.

وينص مشروع القانون AB 2017، الذي قدمه عضو الجمعية التشريعية مات هاني، على إضافة أول أيام شهر شوال، باعتباره عيد الفطر، واليوم العاشر من شهر ذي الحجة، باعتباره عيد الأضحى، إلى قائمة العطلات الرسمية في الولاية.

ولا يعني القانون أن جميع العاملين في كاليفورنيا سيحصلون تلقائياً على يومين إضافيين مدفوعي الأجر، إذ تنص أحكامه على أن موظفي الولاية يمكنهم استخدام ثماني ساعات من رصيد الإجازة أو الإجازة السنوية أو الوقت التعويضي للاحتفال بالعيدين، وفق حاجات العمل والاتفاقات الجماعية المعمول بها.

كما يسمح القانون للمدارس العامة والكليات المجتمعية في كاليفورنيا بالإغلاق في عيد الفطر أو عيد الأضحى، وفق اتفاقات يتم التوصل إليها محلياً، إلى جانب اعتبار غياب الطالب بسبب الاحتفال بأي من العيدين غياباً مبرراً.

وتأتي الخطوة في ولاية تضم واحدة من أكبر التجمعات المسلمة في الولايات المتحدة. ووفق دراسة حديثة لمركز بيو للأبحاث، يعرّف نحو 1% من البالغين في كاليفورنيا أنفسهم بأنهم مسلمون، فيما يقدر المركز حجم المجتمع المسلم الأمريكي بنحو 4.5 مليون بالغ، مع اختلاف التقديرات بحسب منهجية القياس والفئة العمرية المستخدمة.

ويحمل القانون أيضاً بعداً تعليمياً، إذ يسمح للمؤسسات التعليمية بإدراج أنشطة تتناول تاريخ عيد الفطر وعيد الأضحى، كما يتيح للمدارس والكليات تنظيم إغلاقها في موعد العيدين وفق الترتيبات المحلية، وهو ما يمنح المؤسسات التعليمية مرونة أكبر في التعامل مع المناسبتين.

وتصبح أهمية القرار أوضح عند مقارنته بخطوة مماثلة اتخذتها ولاية واشنطن في أبريل 2025، عندما وقّع الحاكم بوب فيرغسون قانوناً أضاف عيد الفطر وعيد الأضحى إلى قائمة العطلات الرسمية للولاية، لتصبح واشنطن أول ولاية أمريكية تتخذ هذه الخطوة. إلا أن قانون واشنطن لا يجعل العيدين عطلتين مدفوعتين تلقائياً لجميع العاملين.

وبذلك تنضم كاليفورنيا إلى واشنطن في الاعتراف القانوني بعيدَي الفطر والأضحى على مستوى الولاية، في وقت يتزايد فيه حضور المسلمين في الحياة العامة الأمريكية، فيما يظل تطبيق ترتيبات الإجازة وإغلاق المدارس مرتبطاً بالقوانين المحلية والاتفاقات الجماعية وطبيعة جهة العمل.

California Governor Gavin Newsom signed a bill that adds the holidays of Eid al-Fitr and Eid al-Adha to the state's list of holidays, in a move that grants them official recognition in California law and allows for special arrangements for employees and students to celebrate them.

The bill AB 2017, introduced by Assemblymember Matt Haney, stipulates the addition of the first day of the month of Shawwal, recognized as Eid al-Fitr, and the tenth day of the month of Dhu al-Hijjah, recognized as Eid al-Adha, to the list of official holidays in the state.

This law does not mean that all workers in California will automatically receive two additional paid days off, as its provisions state that state employees can use eight hours of vacation time, annual leave, or compensatory time to celebrate the two holidays, depending on work needs and existing collective agreements.

The law also allows public schools and community colleges in California to close on Eid al-Fitr or Eid al-Adha, based on locally reached agreements, and considers a student's absence due to the celebration of either holiday as an excused absence.

This step comes in a state that has one of the largest Muslim populations in the United States. According to a recent study by the Pew Research Center, about 1% of adults in California identify as Muslim, while the center estimates the size of the American Muslim community to be around 4.5 million adults, with variations in estimates depending on the measurement methodology and age group used.

The law also carries an educational dimension, as it allows educational institutions to include activities that address the history of Eid al-Fitr and Eid al-Adha, and enables schools and colleges to organize their closures on the dates of the two holidays according to local arrangements, providing educational institutions with greater flexibility in handling the occasions.

The significance of the decision becomes clearer when compared to a similar step taken by Washington State in April 2025, when Governor Bob Ferguson signed a law that added Eid al-Fitr and Eid al-Adha to the state's list of official holidays, making Washington the first U.S. state to take this step. However, the Washington law does not automatically make the two holidays paid days off for all workers.

Thus, California joins Washington in the legal recognition of Eid al-Fitr and Eid al-Adha at the state level, at a time when the presence of Muslims in American public life is increasing, while the implementation of leave arrangements and school closures remains tied to local laws, collective agreements, and the nature of the workplace.
